Landlords Gather and Campaign for Equality!
 
 
We have been living and investing in property in Hong Kong (HK) for years, and HK  had  been  a  pleasing  environment  to  live  in.   However, the recent law  
enforcement over the unauthorized building work (UBW) issue has greatly  
disappointed us.  
 
The government’s way of dealing with UBW used to be well sequenced, i.e. orders to demolish the most dangerous UBW were delivered in the first place, followed by those less dangerous or less serious. This has been implemented  
effectively and efficiently throughout the years. However, the policy was revised on 1st April 2011, claiming that ALL kinds of UBW must be demolished  
immediately, no matter how small-scale or how environmentally friendly the UBW was. The so-called UBW refers to everything additional, e.g. a light-weight partition wall, a simple flower bed, a single shelter against sunshine on your roof, etc. etc. These works are commonly seen in many American and  
European countries and are considered to be a touch of creativity in our living  
environment as they are very safe and are without having any structural  
alternations. It is simply ridiculous and disturbing to demolish such additional works in HK.  
 
That newly enforced policy caused serious dispute between the government and many HK landlords, while the New Territories villagers rose and protested with thousands of people in June 2011. As such, the government formed a committee to compromise the discrepancy between the villagers and the government, which then suggested a reporting system stating certain kinds of the reported UBW in village houses can have its demolishment delayed. This suggestion of reporting system indicates that the policy issued on 1st April 2011 was definitely not working. At that time, both the  Chief Executive Mr. Donald Tsang and the  
Secretary for Development Mrs. Carrie Lam had publicly announced that  
sequencing would be applied in dealing with UBW in any regions in HK,  
implying that the policy updated on 1st April 2011 has been amended or even  
declined. Upon the questioning by a Councilor Mr. Lee Wing Tat, Lam claimed that every landlord in HK would be treated equally between Hong Kong, Kowloon and New Territories.  
 
 
After that, at the instant when the policy was still unsure and the majority of  
villagers were still opposing to the reporting system, the government kept  
enforcing demolishment of all kinds of UBW in Kowloon and Hong Kong Island, but exempting New Territories landlords from the demolition orders. Such  
distorted treatment is absolutely against the principle of equality as promised by the government. We see obvious injustice from the double standards the  
government treated UBW in Kowloon and Hong Kong Island versus UBW in the New Territories. It is very important for us to rise and to tell the public how we suffer from the unfair and differential treatment. We must gather together not only voice out but also approach them to grant our request until success.

終止不公平 - 港九區業主大行動
 
 
我們為一群港島區業主,多年來於香港置業,一直盡力配合各種政策。近日從政府處理僭建問題中,覺察到港九區業主的權益受到不平等對待,故特致函徵求各位業主的共鳴及回響,讓政府回應我們的訴求。

在處理僭建物的問題上,政府以往一直採取「先後緩急」的策略,先出命令拆除危險性高而違規情況嚴重的違例建築,再拆卸其餘情況不太嚴重的。此法恆之有效,亦令資源得以有效率地運用。然而,屋宇署於2011年4月1日公佈一項經修訂的執法政策,要求立刻清拆所謂「僭建物」,即一切不在原圖則上的結構,不論該結構是否有實際的危險性,而且漠視環境因素 (一些樓宇的天台建設可綠化環境,甚至有保護樓宇的作用,為何必須拆掉?難道業主花數十萬乃至上百萬買得的天台,只能用作晾曬衣物嗎?)。事實上,大部份加建物在歐美國家被視為業主改善生活、享受生活的一般做法,根本不構成違例 (港英政府官僚作風遺留下的舊例);在不合情理和沒有改動結構的情況下要求清拆天台、露台等一般普通加建物,對一眾香港業主而言可謂是一種「惡法」(即為極度擾民的法律)。

新修訂條例頒佈之初,很多香港的業主均大受困擾,而新界村屋業主的反對聲音最為激烈,鄉議局更於2011年6月發起逾百輛旅遊巴及逾千人包圍舊立法會大樓的行動。由鄉議局及發展局成立的「理順小組」下了不少工夫,又提出有關申報機制的方案,讓新界村屋不少僭建物可經由申報而延期拆卸,從而緩和當時劍拔弓張的氣氛。申報機制的提議,正正說明2011年4月1日公佈的執法政策根本不可行。而且,當時的發展局局長林鄭月娥局長曾在接受訪問時多次表明立場,指僭建的執法上有「先後緩急」之分,當時的曾蔭權特首在接受電台訪問時亦再次證實這說法,顯然2011年4月1日所公佈的新令已經歷重大修訂甚至已被取消;林局長更曾在李永達議員的諮詢下一再強調會對港九新界的業主「一視同仁」,即是說假如申報機制在新界順利推行,同樣的機制亦理應在港九區應用。

現在申報機制尚且未獲新界鄉民全部接受,村屋僭建問題尚未得到定案,屋宇署對村屋僭建的執法已差不多全部停頓下來。然而,屋宇署竟又於港九區採用2011年4月1日修訂的新例,不由分說地對僭建物進行清拆,對早前一再承諾的「先後緩急」及「一視同仁」更出爾反爾,颇似是「過橋抽板」!

 
 
「不患嚴而患不公」,法律的理念在於公平公正,但目前新界業主及港九業主卻有顯而易見的差別待遇。全港業主均為納稅人,亦是香港經濟命脈的重要台柱,我們一向沉默,並不是代表我們就是懦弱,為甚麼港九業主的權益低於新界業主?可是,若然我們不站出來,永遠没有人知道我們的權益被踐踏、忽視。港九業主必須主動挽回我們真正納稅人的尊嚴及權益,為自己爭取公平待遇!
